Domestic Violence, Repeat Offender – Conditional Discharge (no conviction)


CC: s.266 – Assault, s.811 – Breach of Peace Bond Conditions


My client was on a Peace Bond for a prior incident of assaulting his wife.  In this new case, he was accused of breaching the “no contact” condition of that peace bond, and of assaulting her again, this time by choking her in a fit of rage.


The Crown was seeking a period of jail, followed by a period of probation. However, I persuaded the judge to grant him a Conditional Discharge, resulting in no criminal record.
