Sexual Assault & Violence at Concert (Tsuu Tina) – Charges Withdrawn

Charges:    CC: s.151 – Sexually Touching a Minor, s.271 – Sexual Assault, s.270(1)(B) – Assault with Intent to Resist Arrest, s.129(A) – Resisting Arrest.

Allegations:
My client was at the Grey Eagle Casino Event Centre for a concert.  He was intoxicated and approached a random girl there, placing his hands on her lower back and buttocks.  She notified a security guard, who then tried to force my client to leave.  However, he resisted and became aggressive with security.  When police intervened, and tried to place my client under arrest, he assaulted a police officer, grabbing him and ripping his uniform, and tried to strike at other officers.  He was wrestled to the ground and subdued.  After being brought back to his feet, he tried to take a police officer’s service pistol.  Again, he was wrestled to the floor and subdued.  As they were escorting him outside the building, he was angry and swearing and kicked at a glass panel door.

Result:
Charges Withdrawn.  My client received a Conditional Discharge for obstruction.

Drunken Crash and Rollover (Brooks) – Minimum Fine

Charges:
CC: s.253(1)(A) & (B) – Impaired Driving; TSA: s.115(2)(B) – Careless Driving.

Allegations:
My client crashed and rolled his truck at 2:00 am.  Police attended and dealt with my client, who was injured from the accident.  They took him to the hospital and obtained a blood warrant, after suspecting that he was intoxicated.  The results proved that he was double the legal limit.

Result:
He pleaded to Impaired Driving and received the minimum fine and could drive again after 3 months, with Alcohol Ignition Interlock Device.

Angry Boyfriend Assaults GF & Her Daughter (Airdrie) – Charges Withdrawn

Charges:
CC: s.266 – Assault x 2, s.264.1(1)(A) – Uttering Threats

Allegations:
One one occasion, my client had an argument with his girlfriend earlier in the morning.  Then, while she was having a coffee in the garage, he grabbed her from behind and shook her violently, causing her coffee to spill all over her face and clothing.  On another occasion, my client angrily walked past his girlfriend’s daughter and body-checked her very hard, causing her to fall down.  On another occasion, he threatened to smash his girlfriend’s head against the wall and to break to her neck.  He also threatened to burn her with a cigarette.

Result:
Charges Withdrawn.  Resolved with a Peace Bond.

Excessive Spanking of Baby (Okotoks) – Charges Withdrawn

Charges:
CC: s.266 – Assault (Baby)

Allegations:
Child and Family Services were contacted by the hospital in relation to suspicious bruising on a 1 year-old boy, after his mother brought him in for an examination.  She indicated that the injuries occurred while he was staying with his father (her ex-husband) over the weekend.  His buttocks were bruised and marked from excessive spanking, and his genitals were swollen also from being spanked excessively.  When the father indicated that he was out of town and left the baby with his girlfriend, my client, she denied any knowledge of how those injuries could have gotten there.  However, the guilt was eating her up, so she turned herself the next day at the RCMP detachment, and confessed to being responsible for hurting the child out of frustration because he wouldn’t stop crying.

Result:
Charges Withdrawn.  Following extensive resolution discussions, as well as the preparation of a Pre-Sentence Report and a Psychological Assessment, I managed to obtain for my client a Conditional Discharge.

Post Strip Club Domestic Dispute (Calgary) – Charges Withdrawn

Charges:
CC: s.266 – Assault, s.811 – Fail to Comply with Peace Bond

Allegations:
My client was bound by conditions of a Peace Bond, relating to a prior assault upon his wife, when he assaulted her again, thereby breaching his conditions.  At 2:00 am, one morning, my client returned to his residence, intoxicated, after a night out with friends at a strip club.  His wife got angry with him and the argument escalated to the point where my client smashed his phone on the floor, then grabbed her by the throat and began choking her, while he cursed and insulted her.  He took their money and told her he was leaving her.  She said she was going to call the police.  He told her if she called the police, she would never see him again.

Result:
Charges Withdrawn.  My client received a Conditional Discharge.
