Don’t Bully My Little Sister! (Strathmore) – Charges Withdrawn

Charges:    CC: s.267(A) – Assault with a Weapon

Allegations:
My client and her boyfriend suddenly pulled into a parking lot, where the complainant was hanging out with her friends.  Their vehicle struck two of the girls, knocking them to the ground.  My client got out of the car and began yelling and threatening them.  Her boyfriend got out of the car and proceeded to smash their vehicle with a shovel.  My client pulled out a knife and threatened them to stay away from her little sister (whom they had been bullying at school).  The complainant’s friend got into her vehicle, the girls jumped in and drove straight to the police station.

Result:
Charges Withdrawn.  Resolved with a Peace Bond.

Corporate Trust Theft and Fraud (Calgary) – Jail

Charges:
CC: s.334(A) – Theft Over $5000, s.380(1)(A) – Fraud Over $5000.

Allegations:
My client was an Executive Assistant to the Simpson Family, who own and operate CANA Construction.  Over a period of 6 months, my client embezzled over $70,000 from the company, through the misappropriation of funds and misuse of the corporate credit card for personal cash advances.

Result:
After a Preliminary Inquiry, my client pleaded guilty and received a sentence of 12 months incarceration.  The Crown was asking for 2 years.

Violent Revenge on the Reserve (Turner Valley) – Charges Withdrawn

Charges:
CC: s.348(1)(B)/268 – Break & Enter and Commit Aggravated Assault, s.348(1)(B)/430 – Break & Enter and Commit Mischief, s.88(1) – Possession of a Weapon for a Dangerous Purpose, s.264.1(1)(A) – Uttering Death Threats, s.145(5.1) – Breach of Undertaking.

Allegations:
My client’s cousins were attacked and stabbed by a couple of other guys from their reserve, so he and a few members of his family (including his brother and his father) found them and got revenge.  They broke into their house with weapons.  One guy had a baseball bat in one hand and a knife in the other, threatened to kill them, and slashed one guy’s arm.  My client swung a steel pipe around and broke one guy’s arm with it.  Another struck another guy in the head with a golf club.  They fought back and fists were thrown before my client and his family left.  The guys they attacked suffered numerous injuries, requiring medical attention.

Result:
On the day of trial, the Crown agreed to withdraw all charges and to resolve with a Peace Bond.

House Party Bathroom Sexual Assault (Calgary) – Probation

Charges:
CC: s.271 – Sexual Assault

Allegations:
My client sexually assaulted a woman at a friend’s big 50th birthday house party.  The woman was using the washroom, and when she opened the door to leave, my client, who was standing there, pushed her back into the washroom and closed the door.  He then began shoving his hands down her pants, trying to touch her vagina.  She fought him off and left.

Result:
I was able to keep my client out of jail by getting him a Conditional Sentence Order for 6 months, followed by 12 months probation, with a curfew.

Armed Robbery of Liquor Store (Calgary) – Time Served & Probation

Charges:
CC: s.344(1)(B) – Armed Robbery, s.351(2) – Face Masked While Committing an Indictable Offence, s.266 – Assault

Allegations:
My client tried to rob a liquor store at gun point, wearing pyjamas, a hoody and a scarf over her face.  She was highly intoxicated.  She pointed an imitation firearm (a BB handgun) at the store clerk and said: “Give me all your money.”  The clerk immediately rushed my client, grabbed the gun from her, and had a customer hold her down until the police arrived. She also had an outstanding assault charge from a different incident.

Result:
My client was initially denied bail in Provincial Court when she had a different lawyer.  Months later, her father retained me.  I was able to get her out of jail with a sentence of time served plus probation.
